Terms & Conditions

Please review the terms and conditions carefully prior to contacting me about your project.  

COPYRIGHT

Copyright of the finished artwork is retained by the artist. The artwork may be used for promotional reasons in social media or in a website portfolio. If you wish not to have your commissioned artwork on social media for privacy reasons please inform me at the start of the project. You may not make duplications of the finished artwork for profit or otherwise. Please contact me if you would like prints made of your artwork.

PAYMENT

A 50% non-refundable deposit fee is due at the start of the project to cover the artist’s time, administration, and materials used. The final payment is due when the project is completed. Payments can be made through e-transfer or PayPal to barbsotiart@gmail.com. 

SHIPPING

All orders are shipped directly to you with a tracking number and insurance. If you would like your artwork shipped to a different location please indicate that in your initial correspondence with me.

The artwork is shipped within 1-3 business days from completion. If you require your artwork by a specific date please let me know so we can create a work-back schedule that accommodates this. Depending on my schedule and wait times I may or may not be able to accommodate this but will do my best if time allows.

I use Canada Post for all shipped orders. If another shipping provider is required this may result in an additional fee.

CANCELLATIONS

Cancellations must be made by email only. The 50% non-refundable deposit fee will be retained as a loss of business, to cover the artist’s time, materials, emails, mock-ups, and any fees. If a cancellation is made and work has already been started on the art, the artist will retain the artwork at whatever stage it is in.

Your happiness with your art investment is extremely important to me, so please contact me about any issues that may arise.

CLIENT CONDUCT

The client agrees to respond to emails regarding proofs and revisions in a timely manner (3-5 business days). If the client has not responded with that time, a follow-up email will be sent. If there is still no response, the artist reserves the right to postpone the project until a response is received. This can affect the due date of your project.

Although the occurrences are rare, the artist also reserves the right to cancel the project due to abusive behavior or if a failure to respond in a timely manner occurs multiple times in the course of the project causes significant delays. Upon the artist canceling the project, the artwork will also be retained along with the 50% non-refundable fee.

TIMING

I will provide an estimated completion date in your customized quote. Please indicated if you require your artwork for a specific date (e.g. birthday, anniversary) in your initial email to me about the project. I will do my best to accomodate those requests, but it may not always be possible depending on my shedule and time of year.

PROCESS & REVISIONS

The primary mediums that I work in which are colored pencil and ink, are not very forgiving. Therefore, revisions at late stages or completion of the project are next to impossible without compromising the quality of the finish of your piece or completely starting over. 

For this reason, I like to get approval of your drawing(s) in stages. This initial stage is deciding on what style you would like the drawing done in and what kind of crop you would like, eg. head, head and some neck and shoulders or entire body. I will then select images I think fit your request and do a line drawing. Once a line drawing is approved, I will go ahead with the rendering and detail of the image.

In cases where likeness is important, like portraits, the face will be rendered first and I will send you an email with a photo of that section of the artwork to make sure you are satisfied with the result before proceeding to other areas of the artwork.

PLEASE NOTE: A maximum of 2 revision requests is allowed at the line drawing stage. Anything beyond that will result in an additional fee and could affect your time of completion.

DAMAGE OF SHIPPED ARTWORK

Tracking and insurance are added to each shipped artwork. The artwork is packaged to prevent damage, however, in the event that damage may occur during transit please send a photo of the damaged artwork to me via email right away. The damaged artwork must be returned to me and a new version will be drawn at no cost. Complete recreations of the damaged artwork may not be able to be done right away depending on the size, complexity, and waiting list in my schedule.

PRIVACY POLICY

I take your privacy seriously and will not sell, distribute, or lease your personal information to third parties. You will be added to an exclusive email list for my commission clients for the purpose of correspondence on the project and will receive occasional emails on promotions. If you wish to not receive promotional emails from me after the project is complete, please let me know.

TAXES & IMPORT FEES

The payment of taxes and import duty may be applicable in some countries. This is the sole responsibility of the client.
